Article 1 - Definitions

  1. Student company:One or more students from an educational institution who, as part of their curriculum, form a company under the legal and fiscal responsibility of Stichting Jonge Honden.
  2. Stichting Jonge Honden:A foundation that offers educational institutions the opportunity to allow students to participate in the concept of a student company. Stichting Jonge Honden is responsible for financial processing, insurance, and reporting to the tax authorities.
  3. Stichting Studentenbedrijf:Responsible for managing the website www.studentenbedrijf.nl and shop.studentenbedrijf.nl.
  4. Educational institution:The school or university with which Stichting Jonge Honden has an agreement to offer the student company concept.
  5. Cooling-off period:The period during which the customer may cancel.
  6. Users:All visitors to the webshop.
  7. Customers:A person who purchases something without a business reason.
  8. Right of withdrawal:The customer's right to cancel a purchase within the cooling-off period.
  9. Distance agreement:A purchase agreement made via the internet or telephone.

Article 2 - Details of the student company

1. The student company operates under the KvK and VAT number of Stichting Jonge Honden.

2. Stichting Jonge Honden is responsible for the financial, tax, banking and legal steps taken by the student company.

Article 3 - When these terms apply

1. These terms apply to any offer from the student company and any agreement made via the internet or telephone.

2. Before the customer purchases anything, they can read the terms. If that is not possible, the customer will receive them digitally so that they can be saved.

 

Article 4 - The offer

1. If an offer has a limited validity period or is subject to conditions, this will be clearly indicated.

2. The offer contains a clear description of the product or service. If there are images, they correspond to the product. Errors in the offer are not binding.

3. The offer contains all the information the customer needs to know their rights and obligations.

 

Article 5 - The agreement

1. The agreement is concluded as soon as the customer accepts the offer and meets the conditions.

2. If the customer accepts the offer online, they will receive a confirmation by email. If the customer does not receive a confirmation, they can cancel the agreement.


Article 6 - Right to cancel

1. The customer may cancel a purchase within 14 days without giving a reason. The student company may ask why the customer is cancelling, but the customer is not obliged to disclose this.

2. The reflection period begins on the day the customer receives the product.

3. A reflection period of 14 days also applies to services and digital content, which starts on the day of the agreement. If the student company has already incurred costs for providing the service, the customer must pay these.

 

Article 7 - What the customer must do during the reflection period

1. During the reflection period, the customer must handle the product and packaging with care. The customer may only use the product as they would in a shop.

2. If the product decreases in value due to the customer's fault, the customer may be held liable for this.

 

Article 8 - How the customer can cancel and the costs involved

1. If the customer wishes to cancel, they must notify this within the reflection period using the model form or in another clear manner.

2. The customer must return the product as soon as possible, but within 5 working days. This is not necessary if the student company offers to collect the product themselves.

3. The product must be returned with all accessories and, if possible, in the original packaging.

4. The customer is responsible for the risk of return.

5. The costs of return are the responsibility of the customer.

 

Article 9 - What the student company must do in case of cancellation

1. The student company confirms by email that they have received the cancellation.

2. The student company will reimburse all costs incurred by the customer for the returned product, excluding return shipping costs.

 

Article 10 - Exceptions to the right to cancel

1. The customer cannot cancel if the customer

o Has ordered a customised product.

o Has purchased a product that spoils quickly.

o Has opened a sealed product that cannot be returned for hygiene reasons.

o Has purchased a product that has been irrevocably mixed with other products.

o Sealed audio or video recordings that have been opened.

 

Article 11 - The price

1. The prices in the offer are inclusive of VAT and will not be increased during the validity period of the offer, except in the case of changes in VAT rates.

2. Price increases within 3 months after the conclusion of the agreement are only permitted if determined by legal regulations.

3. Price increases after 3 months are only permitted if the customer has the right to terminate the agreement.

 

Article 12 - Quality and additional guarantee

1. The student company guarantees that the products and services comply with the agreement and legal requirements.

2. Additional guarantee is a promise that goes beyond the legal obligations of the student company.

3. The additional guarantee from the student company does not limit the legal rights that the customer has.

 

Article 13 - Delivery and execution

1. The student company will handle the customer's order carefully and deliver it as quickly as possible, no later than within 30 days.

2. If there is a delay in delivery, the customer will be informed within 30 days. The customer then has the right to cancel the agreement free of charge.

3. The risk of damage or loss of products lies with the student company until the moment of delivery.

 

 

 

Article 14 – Payment

1. The customer must make the payment immediately via iDEAL, unless otherwise agreed.

 

Article 15 - Additional rules

1. The customer is reminded that they are purchasing from a student company, which operates differently from a regular business.

2. The customer should take this into account when placing orders, returns, and communication.

3. The student company operates under the KvK and VAT number of the foundation Jonge Honden.

4. Foundation Jonge Honden is responsible for the financial, tax, banking, and legal steps taken by the student company within the established rules.

5. Teachers from the affiliated educational institutions monitor the students for compliance with the rules.

6. Both foundation Jonge Honden, Foundation Student Company, and the supervising teachers from the educational institution have access to the orders and data of the customers. This is to support the student company in their educational activities.
